Tank Guard Warranty

TANK-GUARD® OIL TANK PROTECTION PROGRAM WARRANTY DETAILS.

While your eligible above ground heating oil tank (maximum capacity of 330 gallons) is treated with TANK-GUARD, Lincoln Laboratory, P O Box 381, Leicester, MA 01524, the manufacturer of TANK-GUARD provides the following lim9ted warranty for one year from the date of invoicing: If during this period your aboveground tank leaks from internal corrosion which TANK-GUARD has failed to prevent, you will be eligible to receive a new replacement tank per the details below. Leak verification is required.

1. Bond-Tite Tank Service ( a division of Lincoln Laboratory) will replace the tank and Lincoln Laboratory will pay for the NEW TANK INSTALLATION and for the OLD TANK REMOVAL. The fire-omatic valve, tank gauge and vent alarm will be replaced if needed at no extra charge.

2. The cost for permits, changes required by current safety codes (such as new fill or vent pipes, new oil supply lines, or oil safety valves), difficult to access or other unusual circumstances will be billed to you. You will be responsible for providing access to a tank that has been enclosed or built in, or where there is not adequate clearance to move the tanks in or out of the building.

3. If you or your oil dealer choose another method of replacing your oil tank, you will be allowed a flat rate reimbursement from Lincoln Laboratory. Leak verification by your oil dealer and proof of replacement is required. Your oil dealer will tell you the current flat rate reimbursement amount. Any costs in excess of this amount will be your responsibility.

WARRANTY EXCLUSIONS

The above is your exclusive remedy. Leaking tanks, which have been repaired and underground tanks are not eligible and are excluded. LINCOLN LABORATORY HAS NO LIABILITY FOR ENVIRONMENTAL CLEANUPS OR FOR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES. TO THE EXTENT PERMITTED BY LAW< THERE IS NO WARRANTY OF MERCHANTABILITY OR OTHER IMPLIED WARRANTY. Any claim for breach of warranties must be brought during the one year period or within 90 days thereafter. Some states do not allow certain limitations on implied warranties or the exclusion on incidental or consequential damages or the exclusion of the warranty merchantability, so the above exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights which may vary from state to state.

Oil leaks can pose serious safety and environmental hazards, so we recommend that you check your tank regularly and call your oil dealer at the first sign of a tank leak.
